1. Introduction
These Terms of Service (“Terms”) govern access to and use of the Workermo mobile application, website pages that link to these Terms, and related services (the “Service”). The Service is operated by Workermo Web Portal Services (the “Operator”).
By creating an account, downloading the app, or using any part of the Service, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the Service.
2. Definitions
- “Customer” means a user requesting or purchasing services through the Service.
- “Worker” means a user offering or providing services through the Service.
- “Booking” means a request/order for services between a Customer and a Worker made through the Service, including any chat confirmations and status updates.
- “Platform Fee/Commission” means fees charged by Workermo for operating the marketplace, facilitating payments, and providing platform features.
- “Payment Partners” means third-party payment processors and payment method providers, including PayMongo and payment methods enabled through PayMongo such as GCash.
3. Platform Role (Web Portal Marketplace)
Workermo is a web portal marketplace that connects Customers with independent Workers. Workermo does not recruit, hire, or place Workers into employment relationships, and Workermo is not a labor contracting or employment agency.
Workers are independent providers and are not employees, agents, or representatives of the Operator. Customers and Workers enter into a direct service relationship with each other, including agreement on scope, schedule, location, and price.
Workermo provides tools for discovery, messaging, booking workflows, dispute reporting, and payment facilitation. Workermo does not perform the services offered by Workers and does not guarantee service outcomes.
4. User Eligibility and Account Security
You must be at least 18 years old and legally capable of entering into contracts to use Workermo.
You are responsible for safeguarding login credentials and for all activity under the account. Notify support promptly if you believe an account has been compromised or used without authorization.
5. Payments (PayMongo and GCash)
Bookings may require upfront payment using supported payment methods in the app. Workermo uses PayMongo to process payments. PayMongo may enable payment methods such as GCash.
When you pay through Workermo, you also agree to follow the applicable Payment Partners’ terms, rules, and policies. Payment availability, authorization, and final settlement may depend on Payment Partner and payment-method rules.
6. Holds, Disputes, Refunds, and Payouts
Where applicable, funds may be held or otherwise controlled pending booking completion and/or dispute review, depending on the workflow and the payment method used.
For completed bookings, Workermo may deduct platform fees/commission and facilitate release of net proceeds to Workers, subject to verification, dispute status, and Payment Partner processing timelines.
Refunds and reversals, when applicable, are processed through Payment Partners and may be affected by Payment Partner rules, fraud checks, chargeback handling, or payment-method policies.
7. Cancellations and Rescheduling
Cancellation, rescheduling, refund eligibility, and dispute rules are defined in-app and may vary by booking status, time to scheduled start, and payment method.
Workermo may update cancellation and refund rules to protect safety, prevent abuse, and maintain marketplace integrity. Updates may be communicated through the app or via posted policy updates.
8. Worker Obligations
Workers agree to:
- Provide accurate service listings, pricing, and availability.
- Deliver services in a professional and safe manner consistent with the agreed booking scope.
- Communicate clearly and promptly regarding timing, scope, requirements, and any delays.
- Comply with applicable laws, licensing requirements, and safety standards relevant to the services offered.
9. Customer Obligations
Customers agree to:
- Provide accurate job descriptions, schedule details, location details, and necessary instructions.
- Provide a safe environment for the requested work and comply with applicable laws and safety standards.
- Treat Workers with respect and avoid harassment, discrimination, or unsafe requests.
10. Prohibited Activities
You must not use Workermo to:
- Request, offer, promote, or perform illegal services or activities.
- Engage in fraud, impersonation, identity misuse, or material misrepresentation.
- Circumvent platform fees by moving transactions off-platform after matching through Workermo (where prohibited by in-app rules).
- Harass, threaten, exploit, or discriminate against other users.
- Upload content that violates laws or third-party rights, including intellectual property, privacy, and data protection rights.
11. Disputes
If an issue arises regarding service quality, payment, or completion, a dispute may be opened within the app in accordance with platform rules. During dispute review, funds may be held where applicable while Workermo facilitates a review process.
Workermo may request supporting evidence (messages, photos, booking details) to help evaluate a dispute. Dispute outcomes may depend on the available evidence, platform rules, and Payment Partner constraints where payments are involved.
12. Content and Reviews
Users may submit content such as profile details, service descriptions, photos, messages, and reviews. You are responsible for content you submit and confirm that content is truthful and that you have the right to submit it.
Workermo may remove or restrict content that violates these Terms, platform rules, or applicable law, including content that is misleading, abusive, or infringes third-party rights.
13. Limitation of Liability
To the fullest extent permitted by law, Workermo is not liable for personal injury, property damage, loss, or disputes arising from interactions or services between Customers and Workers.
To the fullest extent permitted by law, Workermo’s total liability for a specific booking is limited to the platform fees/commission actually received by Workermo for that booking.
14. Account Suspension and Termination
Workermo may suspend or terminate accounts for fraud, abuse, safety concerns, repeated cancellations/no-shows, non-payment, chargeback risk, or violation of these Terms or platform rules.
You may stop using Workermo at any time. Account deletion requests may be subject to retention requirements for security, dispute handling, and legal compliance.
15. Governing Law
These Terms are governed by the laws of the Republic of the Philippines, without regard to conflict-of-law principles.
16. Changes to These Terms
Workermo may update these Terms from time to time to reflect changes in the Service, marketplace rules, or legal requirements. If changes are material, notice may be provided through the app or via registered contact details.
Continued use of the Service after updated Terms take effect means acceptance of the updated Terms.
