Terms of Service

1. Introduction
These Terms of Service ("Terms") govern your access to and use of the Workermo mobile application and related services (the "Service"). The Service is operated by [Insert Legal Entity Name] (the "Operator").
By creating an account or using Workermo, you agree to be bound by these Terms and the Privacy Policy.
2. Definitions
- "Customer" means a user requesting or purchasing services.
- "Worker" means a user offering or providing services.
- "Booking" means a request/order for services between a Customer and a Worker through the Service.
- "Platform Fee/Commission" means fees charged by Workermo for facilitating the marketplace.
- "Payment Partners" means third-party payment processors including PayMongo and payment methods enabled through PayMongo such as GCash.
3. Platform Role (Web Portal Marketplace)
Workermo is a web portal marketplace platform that connects Customers with independent Workers.
Workermo is not an employment placement agency and does not recruit, hire, or place workers into employment relationships.
Workers are not employees, agents, or representatives of Workermo. Customers and Workers enter into a direct service relationship with each other.
Workermo provides in-app tools for booking, messaging, dispute handling, and payment facilitation, but does not perform the services offered by Workers.
4. User Eligibility and Account Security
You must be at least 18 years old and legally capable of entering into contracts to use Workermo.
You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
5. Payments (PayMongo and GCash)
Customers may be required to pay upfront using supported payment methods in the app.
Workermo uses PayMongo to process payments. PayMongo may enable payment methods such as GCash.
By paying through Workermo, you also agree to comply with the applicable Payment Partners' terms, rules, and policies.
6. Holds, Disputes, Refunds, and Payouts
Where applicable, payment funds may be placed on hold pending booking completion and/or dispute review, depending on the workflow and the payment method used.
Workermo may deduct platform fees/commission for completed bookings and facilitate release of net proceeds to Workers, subject to verification, dispute status, and partner processing timelines.
Refunds and reversals may be processed through Payment Partners. Payment outcomes can be affected by Payment Partner rules, fraud checks, or banking/payment method policies.
7. Cancellations and Rescheduling
Cancellation, rescheduling, refund eligibility, and dispute rules are defined in-app and may vary by booking status and payment method.
Workermo may update these rules to address fraud, safety, marketplace integrity, or operational requirements. Material changes may be communicated through the app.
8. Worker Obligations
- Provide accurate service listings, pricing, and availability.
- Deliver services in a professional and safe manner, consistent with the agreed booking scope.
- Communicate clearly and promptly regarding timing, scope, and requirements.
- Comply with applicable laws, licensing requirements, and safety standards relevant to the services offered.
9. Customer Obligations
- Provide accurate job descriptions, schedule details, and necessary instructions.
- Provide a safe environment for the requested work and comply with applicable laws and safety standards.
- Treat Workers with respect and avoid harassment, discrimination, or unsafe requests.
10. Prohibited Activities
- Request, offer, or perform illegal services or activities.
- Engage in fraud, impersonation, or misrepresentation.
- Circumvent platform fees by moving transactions off-platform after matching through Workermo.
- Harass, threaten, or discriminate against other users.
- Upload content that violates laws or third-party rights, including intellectual property and privacy rights.
11. Disputes
If an issue arises regarding service quality, payment, or completion, a dispute may be opened within the app in accordance with platform rules.
During dispute review, payment funds may be held where applicable while Workermo facilitates a review process.
Workermo may request supporting evidence to help evaluate the dispute and does not guarantee any specific outcome.
12. Content and Reviews
Users may submit content such as profile details, service descriptions, photos, messages, and reviews.
You are responsible for content you submit and warrant that you have the right to submit it.
Workermo may remove content that violates these Terms, platform rules, or applicable law.
13. Limitation of Liability
To the fullest extent permitted by law, Workermo is not liable for personal injury, property damage, loss, or disputes arising from interactions or services between Customers and Workers.
To the fullest extent permitted by law, Workermo's total liability for a specific booking is limited to the platform fees/commission actually received by Workermo for that booking.
14. Account Suspension and Termination
Workermo may suspend or terminate accounts for fraud, abuse, safety concerns, non-payment, chargeback risk, or violation of these Terms or platform rules.
You may stop using Workermo at any time. You may request account deletion subject to applicable retention requirements.
15. Governing Law
These Terms are governed by the laws of the Republic of the Philippines, without regard to conflict-of-law principles.
16. Changes to These Terms
Workermo may update these Terms from time to time.
If changes are material, notice may be provided through the app or via registered contact details. Continued use after updates take effect means you accept the updated Terms.
